Terms of Use

1. Who we are

Klaxon is operated by Domenic Morabito, a sole proprietor doing business as 830 Empire, located in the State of New York, United States. In these terms, “we” and “us” mean that operator. By creating an account or using Klaxon, you agree to these terms. If you do not agree, do not use Klaxon.

You must be at least 13 years old to use Klaxon. If you are under 18, you may use Klaxon only with the involvement of a parent or guardian.

2. What Klaxon does

Klaxon monitors publicly available course registration information from supported schools and notifies you when a section you are tracking appears to have an open seat.

Klaxon is not affiliated with, endorsed by, or sponsored by any college or university. School names are used only to describe which registrars we monitor.

3. What Klaxon does not promise

We do not guarantee that you will get a seat in any class. Klaxon reports what a registrar publishes, and that information can be delayed, incorrect, or change between the moment we see it and the moment you act on it. Seats are often taken within seconds.

We do not guarantee that alerts will be delivered, delivered on time, or delivered at all. Delivery depends on services we do not control, including Discord, Apple, Google, and your own device and network. Registrars also change how their systems work without notice, which can interrupt monitoring.

Klaxon is a tool that improves your chances. It is not a registration service and it does not register you for anything.

4. Subscriptions and billing

Klaxon is a paid subscription. Current pricing is $6.99 per month or $49.99 per year. The annual plan additionally covers Winter and Summer terms. Prices are shown before you purchase and may change with notice; a change never applies to a term you have already paid for.

Subscriptions renew automatically at the end of each billing period until cancelled. You are charged at the start of each period using the payment method on file.

Where you bought your subscription determines who bills you. If you subscribed through the Apple App Store, Apple bills you and manages your subscription. If you subscribed on the web, our payment processor Stripe bills you.

5. Cancelling

You can cancel at any time, and you keep access until the end of the period you have already paid for. Cancelling stops the next renewal; it does not end your current period early.

Cancel from Settings inside Klaxon, which sends you to whichever service bills you. Subscriptions bought on the web can be cancelled on the web. Subscriptions bought through the App Store must be cancelled through Apple, because only Apple can cancel them.

Deleting your Klaxon account does not cancel your subscription. Cancel first, or you will continue to be billed.

6. Refunds

Purchases made through the Apple App Store are refunded by Apple under Apple’s policies; we cannot issue those refunds. For purchases made on the web, contact us at support@klaxon.gg and we will consider refund requests in good faith.

7. Acceptable use

You agree not to:

  • Share, resell, or provide access to your account to others
  • Attempt to access Klaxon by automated means outside the app, or interfere with its operation
  • Use Klaxon to violate your school’s rules or any law
  • Attempt to gain access to accounts, systems, or data that are not yours

We may suspend or terminate accounts that breach these terms. If we terminate your account for a breach, you are not entitled to a refund.

8. Your account

You sign in through Google, Apple, or Microsoft. You are responsible for keeping that account secure. You can delete your Klaxon account at any time from Settings, which permanently removes your data as described in our Privacy Policy.

9. Liability

Klaxon is provided “as is”, without warranties of any kind to the fullest extent permitted by law. We are not liable for missed registrations, classes you did not get into, delayed or undelivered alerts, or any indirect or consequential loss.

Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the twelve months before the claim.

Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

10. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute arising out of these terms or your use of Klaxon will be brought in the state or federal courts located in New York, and you and we each consent to the jurisdiction of those courts.

If you are a consumer, this does not deprive you of the protection of any law of the place where you live that cannot be varied by agreement, and it does not prevent you from bringing a claim in a small claims court where one is available to you.

11. Changes

We may update these terms. If a change is significant, we will tell you before it takes effect. Continuing to use Klaxon after a change means you accept the updated terms.
